Being charged with DWI it means that a prosecutor believes you operated a motor vehicle in a public place while intoxicated. Usually, this is a misdemeanor offense. However, if you have two previous DWI convictions, you could be charged with a felony. Also, if you are accused of being intoxicated with a passenger younger than 15 years old, or if an accident occurs and someone is injured or killed, it is very likely you will be charged with a felony. Both misdemeanor and felony drinking and driving offenses in Texas are extremely serious. You run the risk of going to jail or prison, being fined, losing your driver's license, or possibly losing your job. Drinking and driving charges are unique for two reasons: because of the non-criminal consequences that stem from conviction, and because of the specialized courtroom skills necessary to effectively defend yourself. You do not have to say anything, except... you must, however, provide your true name and a true form of identification.

You do not have to consent to anything: If asked, you may tell the officer s/he may NOT search you, your car or your belongings.

Refuse all field sobriety tests. Most police officers are not properly trained to give these tests and have already decided they are going to arrest you by the time they ask you to take these tests.
